DailyCore Terms of Service

Important Notice: These Terms of Service constitute a legally binding contract between your organization ("Customer" or "Provider") and DailyCore Technologies Australia. By accessing our web dashboard or mobile applications, you agree to these terms. DailyCore provides software management tools; we are not a medical provider or emergency service.
1. Acceptance of Terms & Eligibility
By creating an account, registering for a free trial, signing a service order, or downloading the DailyCore mobile application, you agree to be bound by these Terms of Service, our Privacy Policy, and any accompanying service orders (collectively, the "Agreement").
If you are entering into this Agreement on behalf of a company, partnership, incorporated association, or other legal entity, you represent and warrant that you possess the full legal authority to bind that entity to this Agreement.
2. The DailyCore Platform & Role
DailyCore delivers cloud-based and mobile workforce management solutions designed specifically for Australian NDIS, Aged Care, and Disability Support organizations. Capabilities include:
- Roster scheduling, shift allocation, and real-time mobile push synchronization;
- Field worker shift execution, including GPS-verified clock-in and clock-out, break tracking, and travel mileage recording;
- Clinical and care documentation: Care plans, goals, risk alerts, medication administration records (MAR), and progress notes;
- Digital signature capture for staff and participants;
- Adverse incident and safety reporting;
- Invoice generation and NDIS bulk-claim export formatting.
Non-Emergency Disclaimer: DailyCore is not an emergency response or tele-triage service. In the event of a medical emergency, participant crisis, or immediate threat to life, workers and providers must immediately dial 000.
3. Accounts, Staff Access & Security
The Customer is responsible for:
- Maintaining the strict confidentiality of all login credentials, including passwords and MFA tokens;
- Ensuring that each support worker, coordinator, and administrator is assigned a unique user profile (account sharing is strictly prohibited);
- Promptly disabling access for terminated employees or contractors;
- All activities and data entries conducted under Customer accounts.
4. Customer Data & Participant Consent
Ownership: As between DailyCore and Customer, Customer retains all right, title, and interest in and to all data uploaded or entered into DailyCore, including participant profiles, care plans, shift logs, photos, and signatures ("Customer Data").
Customer Warranties: Customer represents and warrants that:
- It has obtained all legally necessary consents and authorizations from participants (or their legal guardians) to record, upload, and process their sensitive health data in accordance with the Privacy Act 1988 (Cth) and applicable health records legislation;
- It complies with all standards mandated by the NDIS Quality and Safeguards Commission and the Fair Work Act 2009;
- All documentation, timesheets, and incident filings entered on the platform are truthful, accurate, and verifiable.
5. Field Operations, GPS & Electronic Signatures
GPS Geolocation: DailyCore collects device GPS coordinates strictly at the instant of "Clock-In" and "Clock-Out" to corroborate shift attendance at the scheduled service location. The Customer warrants that it has informed its workers and obtained any required workplace surveillance or location-tracking consents.
Digital Signatures: Both parties acknowledge and agree that digital signatures rendered on the DailyCore mobile signature canvas satisfy the legal criteria for electronic execution under the Electronic Transactions Act 1999 (Cth) and are admissible as proof of care delivery.
Offline Mode: DailyCore provides local caching capabilities to allow shift documentation in areas with limited telecommunications coverage. Customer acknowledges that data logged offline remains queued on the local device until internet connectivity is restored and sync is finalized.
6. Subscriptions, Invoicing & Payments
- Free Trials: If Customer registers for a free trial, access is provided without obligation for the trial period. Continued access post-trial requires subscribing to an active plan.
- Fees & Billing: Subscription fees are billed monthly or annually in advance in Australian Dollars (AUD). All listed fees are exclusive of Goods and Services Tax (GST) unless explicitly noted.
- Payment Terms: Customer agrees to maintain valid credit card or direct debit information. Unpaid balances exceeding 14 days may result in account suspension until resolved.
- Price Modifications: DailyCore reserves the right to modify subscription pricing upon providing at least 30 days prior written notice before the next renewal cycle.
7. Acceptable Use & Proprietary Rights
Customer shall not, directly or indirectly:
- Reverse engineer, decompile, or disassemble the DailyCore source code or algorithms;
- Use automated scripts, scrapers, or bots to harvest data from DailyCore;
- Upload malicious software, viruses, or defamatory content;
- Resell, sublicense, or white-label the software without prior written agreement.
DailyCore and its licensors retain exclusive ownership of all software, user interfaces, branding, trademarks, documentation, and underlying technologies.
8. Service Availability & Maintenance
We target a 99.9% platform availability standard, excluding scheduled maintenance windows. Scheduled maintenance will be announced at least 48 hours in advance whenever practicable and conducted during low-traffic Australian hours.
9. Warranties & Limitation of Liability
Australian Consumer Law: Nothing in this Agreement restricts, limits, or modifies any consumer guarantees or non-excludable statutory rights under Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Disclaimer: Except as expressly provided, the platform is supplied on an "AS IS" and "AS AVAILABLE" basis. DailyCore makes no warranties that the service will be entirely uninterrupted, error-free, or meet all specific NDIS audit findings without provider verification.
Liability Cap: To the maximum extent permitted by Australian law:
- Neither party shall be liable for indirect, incidental, punitive, or consequential damages (including loss of profits, goodwill, or clinical business interruption);
- DailyCore's aggregate liability arising out of or related to this Agreement shall not exceed the total fees actually paid by Customer in the twelve (12) months preceding the incident.
10. Term, Cancellation & Data Retrieval
Customer may cancel its subscription at any time via the billing dashboard, with cancellation effective at the conclusion of the active billing cycle.
Upon contract termination, DailyCore provides a 30-day data extraction window during which Customer may export all participant records, notes, timesheets, and invoices. Following this period, customer records are safely archived or purged in accordance with our retention policy.
11. Governing Law & Jurisdiction
This Agreement is governed by and construed in accordance with the laws of the State of Victoria and the Commonwealth of Australia. The parties irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
